Terms of sale

Purpose

These terms of sale govern the sale of artworks by marie bertrand through this website. Any order implies unreserved acceptance of these terms.

Seller

Prices

Prices are shown in euros, inclusive of all taxes. The artist reserves the right to modify prices at any time. Artworks are invoiced based on the prices in effect at the time of the order.

Order and payment

Payment is made online by card through Stripe's secure payment service. The payment is captured after the artwork's availability has been verified.

An order confirmation is sent by email to the buyer once the payment has been validated.

Because each artwork is unique, the sale is subject to availability at the time of confirmation. In the event of simultaneous purchases by several buyers, only the first confirmed order is fulfilled. If the artwork is no longer available, the buyer is notified by email and no amount is charged.

Cancellation and refund

In the event of cancellation of a confirmed order, regardless of the reason (exercise of the right of withdrawal, mutual agreement between the parties, or any other cause), the seller will refund the buyer through their payment account.

Delivery

Studio pickup available (free).

Shipping costs depend on the artwork’s size and destination. The applied charge and total are shown before checkout. Exceptions are confirmed in a proposal including transport costs.

Where the destination charges customs duties or import taxes, particularly outside the European Union, these are included neither in the artwork price nor in the delivery costs. They are collected by the authorities of the destination country or by the carrier, together with any clearance fees, and are payable by the buyer.

The seller undertakes to ship the artwork so that the stated delivery time for the selected destination can be met. If a delay is expected, the seller will inform the buyer as soon as possible.

Right of withdrawal

For any distance purchase of an existing artwork, the buyer has 14 days from receipt to exercise their right of withdrawal without having to justify their decision. The artwork must be returned complete, carefully protected and in the condition in which it was received. The right of withdrawal applies under the conditions and subject to the exceptions provided by applicable law.

The right of withdrawal does not apply to artworks made to the buyer's specifications or clearly personalised (custom orders).

After receiving the request, the seller provides the buyer with the practical instructions needed to return the artwork.

After notifying the seller of their decision to withdraw, the buyer must return the artwork without undue delay and no later than 14 days afterwards.

Return shipping costs are borne by the buyer.

The seller refunds all sums paid, including the initial standard delivery costs, no later than 14 days after being notified of the withdrawal, using the same payment method as for the order. For the sale of an artwork, the seller may defer the refund until the artwork is recovered or until proof of dispatch is received, whichever occurs first.

The online withdrawal function is available through the following link: Right of withdrawal.

The buyer may also inform the seller of their decision by any other unequivocal statement, for example by email.

The artist guarantees the authenticity and originality of each artwork sold. A certificate of authenticity may accompany the artwork. The buyer benefits from the statutory guarantees applicable to the sale.

Applicable law

The buyer remains entitled to bring the matter before any court having jurisdiction under the applicable rules.
